Ok..here's the deal from the stealership
As mentioned before a family member has been looking for a new E320. We want to trade in a 1998 E320 with 77K miles on it. This is what we found.....dealership has a used 2003 E320 with 10K miles on it. Has heated seats, heated steering wheel, 6 disc CD changer, HK sound system, moon roof. dealer has it listed for $46,900.
here's the deal.....Dealer will sell us the car after the trade in for $30,500, and we weren't liking the idea of 1 year of payments with no warranty left, so dealer will starmark the car for 1 year after factory warranty runs out. Monthly payments will be around $599 a month with 4.9% APR
Should we bite?? It would be cheaper than buying an 04, but is it worth it??

How long do you intend on keeping the car? I am a big fan of buying a car with some mileage on it due to the big savings. If you only plan to keep the car for 3 to 4 yrs..I say go with it.
If you intend to drive the car till it dies, then I say go new so that there are no secrets in the car.

i'd say go for a brand new '04...
sell your car privately you will get more for it, then try getting a good deal on a new 'o4 e-class (some are selling below invoice according to a couple of threads here)
the 2004s are way better than the 2003s IMO bcs they have better seats and come standard with command, plus you will be getting a brand new car...

I think the goal is to keep it around 4 to 5 years. It would be hard to sell it privately since once it sold, she wouldn't have a car to drive. She kinda needs to go right from one to the other. She isn't interested in command. Dealer stated that he could sell us a 2004 for $1000 over dealer invoice. But going with the used one saves us around $8K. She is not putting any money down, just the trade-In. She would also save money on taxes going used....correct?

Most states only charge tax on the difference between the sale price and the trade in. This is a real scam for the car dealers. They will take a car from their lot and use it as a trade in for a personal car and then buy back the trade in for the same price - 30 seconds later. They call this a courtesy to each other! The state, you & I, get the shaft.

You can get 04 E320s a little over invoice or below MSRP. My car has the pano roof, sport/appearance pkg, keyless-go, cd changer and I think that's it. Mine listed for $56k and I got it for $49k...though I'm sure it also depends on the trade-in that you're giving them.
For $46k versus a $49k (if you haggle the heck out of the salesman), I'd say go for the newer one of course.
