Dip stick puzzle

According to my owner's manual, an oil level at the mid-point of the red plastic lower section of the dip stick is, in fact, indicating "full". But following the last two oil changes, the oil level was at the tip top of the red plastic section! Are the garage guys over-filling the engine with oil? Does the specified 8.5 quart capacity include say, a quart , captured and retained, and therefore only 6.5 quarts added should re-fill the engine? (FWIW, I always check the oil level the "morning after" and when parked on a level surface.)

It is not that shops overfill the oil, but they under-drain.
Usually they add listed amount of new oil, but when they don't take time to drain the old one, you have 1 or so liters of old stuff still in crankcase.
Cases like that make me doing my own oil changes.
