OK, so there are the lemon laws that were enacted to make manufacturers do the right thing when there is an issue on a new car that can't be resolved. The issue needs to be significant and significantly impact the operation or safety of the car. This means that a squeak or rattle usually won't qualify.

Once a car is "lemoned", the manufacturer can no longer sell the car. They can try to fix it and clearly label it as a lemon and sell it at auction.

Since "lemoning" a car essentially destroys the value and doesn't look good for the manufacturer, many manufacturers will "buy back" the car well before the lemon process begins, so that they can fix it and sell it as a used (but not certified) car.

All manufacturers insist on confidentiality clauses so that the consumer can't talk about the details of the final outcome.
