Complain to BBB Better Business Bureau

Hi,

My 2014 E350 has a transmission problem when it shift from 1st to 2nd, it will jerk like manual transmission. However the problem is not consistent. It happens erratically.
I have gone to dealer over 3 times since I got the car in Jan 2014. 2 out of 3 times the foreman felt it and confirms on the record. They upgraded the software / firmware but did not fix it. one of the service adviser event told me to drive slow before it shift to 2nd gear.

I am going to file a formal complain. Does anyone know where should I file the complain to the MBUSA ? I got my from Stevens Creek Mercedes at San Jose. Or should I just file complain at local BBB ?

I would check to see if you qualify for Lemon Law.
If MB won't fix it, you should qualify for reimbursement or new vehicle, esp if it's in the shop for more than 3 times for same issue...

I thought lemon laws only apply to cars less than 6 months from purchase. Is it true? OP's car is 2014 model.

My 1st post...

I've been following all the threads an a couple of forums about the W212's transmission problem. I wish I had done more research earlier as I appear to have the same problem.

Now, I know this is not a fix, but I do find the trans to be a lot smoother in "S" mode, when from a dead stop, I use the paddle shifter to shift from 1st into 2nd. The car will start in 2nd and will take longer before it shifts automatically into 3rd.

Sounds like a nightmare. I'm currently going through a problem with my 2011 e350 but for motor noise and not transmission. The car will have been to 3 dealers when I drop it off tomorrow. Only difference is that this time I filed a formal complaint with MB Corporate and now I have a regional MB manager handling the case that will oversee what the dealer is doing this time. First thing I would do in your case is take it to another dealer for another opinion and to see if that dealer is willing to work with you. If that doesn't work then have you talked to the service manager at your current dealer? Or even the general manager of the dealer? Both of these two people should be willing to work with you and get the entire transmission rebuilt or a new one put it in. If your current dealer doesn't want to do anything I would just move onto another dealer. If that doesn't work then find the MB corporate number on google (it's a 201 area code number based out of nj) and file a complaint a regional manager/ case manager will call you within 24 hours. That should get the ball moving in the right direction. The transmission problem is well known and they should be attempting to fix it. A gentlemen on here had 2 cars replaced by MB because of this very issue. Don't lay down and take there excuses make them fix it or demand a new vehicle. You didn't spend around 60k for a car that has a jerky transmission.

Ah yes - our 2012 E350 has the identical problem - sometimes very jerky when shifting from 1st to 2nd. Dealer response: normal.

My local dealer took three attempts and had the car for close to a month before they diagnosed and replaced my tranny, but at least they didn't give up.

Contact MBUSA. They will open a case for you and assign a case manager to it. They took care of a $4000 out of warranty repair on my 2008 Bluetec.

BBB is basically a membership group, toothless to enforce anything. As mentioned above your best bet is MB-USA.

I have the exact same problem with my car. Complained since car was new. Contacted MBUSA and they stated they are aware of the problem and are trying to fins a fix. That was a year and a half ago. I found that if I drive the car slow the problem is not as bad. My dealer has reset the trans twice for me from a previous posting from another member that had a bulletin number. It really did no good but I still love the car. They should get a class action suit and I would join. I am 67 years old and have had many cars and this is by far the worst transmission in any of the cars.

Agree, I filed a complaint non auto industry and they were useless.

I filed a lemon law claim in MA on the first year of the new Grand Cherokee Overland (2011) with the air suspension failing almost every two weeks and the vehicle not being driveable. The Jeep went back 7 times and totaling 6 weeks and I won the claim. Got my money back less small mileage charge.

Every state is different. In MA car had to be new, returned 5 times or more for same incident and out of service for 21 days (meaning week days, weekends don't count) and manufacturer still unable to fix the vehicle within 12 months of purchase/lease.

Do not go to another dealer. Get MBUSA involved. If first person you talk to does not handle the way you wish, ask for Executive Case Manager. If that doesn't work, write a letter to the MBUSA CEO.
BBB will contact your dealer and regurgitate whatever they say.
You are lucky that you are in California as it has a very liberal Lemon Law. In SC, a complaint must first be handled by a third party who is paid by the manufacturer. In my case a few years ago with another vehicle, it was BBB! Even though an independent mechanic hired by them agreed with me, they denied claim because in S.C. the car must be unsafe or undrivable. Doesn't matter how long out of service, how many trips to dealer, etc.
Never had this problem with my car fortunately.

I went on website and filled out information about my situation. MBUSA called in 2 days. Not bad.
The rep has to contact the dealership and confirm a couple issues. And will let me know their decision..

BBB only exist to give you peace of mind when your online shopping, other than that it won't do anything outside of the web. I would definitely contact corporate MB or "call curits" local news in sac that does investigative reporting, sure your city, state, country has a local news that does the same.

Always take you complaint to MBusa. BBB wouldnt do anything simply because no one ( at lease me ) wouldnt ask a Mercedes dealer how their BBB record is.
