That's actually not what happened. The court found that one person's (plaintiffs) special request in the case (motion for summary judgement) did not have merit (standing) under state law because he didn't buy the car in that state. Without reading the entire text, hard to say if his case is entirely dead in the water. It does mean that if it's not dead, he's going to have to go though the entire legal process before getting a ruling.

This is a common failure in the earlier days of the 722.9 but I don't think I have seen it on any 722.9 7G-Tronic PLUS models - which lots of W212s have.

I am in contact with buyer of my sedan with 7G transmission and closing on 200k the transmission runs perfect.
I had records that transmission per MB recommendations had only single service at 40k.
I did 2nd service at 180k... just in case.
7G+ transmissions have finer filters and booklet require about 70k fluid change intervals, what is even shorter on bigger engines.
