Lots of people fell for it. I have people come in all the time and ask why our cars don't drive themselves like Tesla.

This is what happens when a CEO doesn't listen to any of his lawyers.

That said I'm not sure they will lose this suit. I owned a Tesla, and I never had the impression I was buying a car that would drive itself. The description of what it does is very clear despite the brand name.

All branding is hyped and I think it is a point almost everyone understands. I mean Mercedes Magic Body Control is not actually magic. BMW's keyless entry still requires you to have a key in your pocket so it isn't keyless. If they don't lie in the product description, they have a defense.

I dont know what the manual said, but MB manuals have more warnings than instructions regarding their system. Furtheremore, they have no advertising stating that their systems are a self driving system in any shape or form.

Yes - like I said - I'm not defending Tesla. I'm surprised that the NHTSA hasn't mandated they change this years ago. But I do think they have a possible defense on this specific suit.

Yesterday I was coming home from Silicon Valley and 10 MPH stop and go. I turned on the Cruise with Lane and distance assist. All I had to do was keep my hands on the Steering Wheel. the car performed flawlessly. Starting and stopping. It anticipated people changing lanes to my lane when they used turn signal. It was great 1 hour of listening to the music while getting the massage. So in some ways it self drove but common sense is not to be watch movies on the phone or taking a nap. Just not having to press break and go pedal constantly is relaxing enough.
My only struggle is weather to turn off reading road signs or not. I don't like it when it slows down but I am engaged enough that I can quickly change it back.

The EQS system is among the best if not, the best driver assistant systems, makes sense since they not only invented them (distronic) but also they have been perfecting it fir decades. Finally they are the only maker to have a government sanctioned fully autonomous driving system.
That said, we are all aware that it "ghosts" occasionally and mistracks when conditions are not 100% perfect, as they often are on American roads because of construction haphazard lines, bad roads, etc. I would NEVER trust it to drive itself, EVER.

Especially in heavy rain, where all my assistance systems shut down this morning for about 15 minutes going around Austin. It was raining cats and dogs. True Texas gullywasher. Had to slow down to 50 in an 80 zone, and only my eyes were still functioning normally. We needed the rain, though!

If you cant see clearly through the winshield the car cant either. The steering part of the sysrem is entirely optical. The sytem turns off entirely when the radar portion is disabled for example by accumulating snow on the front emblem. MB just started adding heated emblems only a gen ago.

Yep, exactly what happened. The car notified me when it could not see.....duh!....and notified me again when it could and everything was functioning again. Really, pretty reassurring. It was bad enough that I actually considered stopping at one point. I was impressed with how the car handled it.
