I have a family member that works for a BMW dealer and yes some dealers have done it but he says that is not worth the risk of getting caught. Big repercussion for dealers if anyone report them so must stay away.

Or, forget that, have you ever purchased something from a private seller and thought to yourself: self, I am paying less than what I should for this widget and it is only right for me to pay more.

As I understand it, your argument is: neither party shall have an upper hand in a transaction regardless of circumstances.
Is that correct?
Yes MSRP has a built in profit for the dealer as all type of retail merchandise, that is why there are discounts and sales from time to time,

And yes I agree on that no party should have the upper hand it should be a win win for both parties.

GM has pretty much banned ADMs because they lead to a non uniform car buying experience and distrust of dealers and loss of brand loyalty. GM is monitoring all used car dealer resales of almost new GM cars in 1st 12 months and dealers with higher rate of resales will lose allocations while dealers with lower rates of resales will gain allocations.
