If you make a DV claim consider suing the party at fault, not their insurance company. For example, the driver may not be the owner, the policyholder, or even an authorized driver.
Never make a DV claim with your IC because there is probably a clause in the contract disallowing the claim. If you make the DV claim with the other company they may work with your company to make sure you share fault. Such a tragic situation concerning a death has been in the news recently...
