Lemon Law / Repurchase
Lemon Law / Repurchase
Hi All,
Unfortunately I'm one of the many that have to undergo the repurchase of the car. The repurchase has already been approved by Mercedes and it's being handled by Sedgwick, however this is my first time having to deal with a repurchase and I could really use your help and expertise. A few quick notes:
1) I'm located in CA
2) The car was financed through MB Financial Services
3) Added the First Class wheel and tire protection plus ($4995)
4) $100,000 down payment
5) Payoff quote was $90,396.31
6) 9 payments already made
The offer they made was a full reimbursement of the down payment ($100,000) & 9 payments, lien holder payoff ($90,853.74), and deduction of $4995 as it's classified as aftermarket equipment.
My questions are:
1) Should I fight them back on reimbursing the full $4995? Or is this normal?
2) The lien holder payoff they're providing is about $500 more, I assume this is to account for the daily interest accrued? If so, do they typically account for the daily accrued interest from offer date to car return date? My worries is that I approve an offer and return the car then later I'm stuck with a bill for the unpaid interest accrued between offer date and car drop off.
3) Does this look fair or should I be fighting back for more?
Thank you all for reading and offering any kind of guidance.

I had a buyback in 2014 on two new e550's and I got paid for the wheel tire and extended warranty purchases - I would push for that. Otherwise it sounds like they are taking good care of you and taking accountability.
re: interest - make it brutally clear you want to further unknown expenses after this is done including any further interest payments. I doubt they'll give you a hard time.
how has it been so far dealing with the point person in the buyback process?

So far it's been fairly easy, however this is just the first email with the case manager. All the previous correspondences were with someone assigning the file, but that was pretty painless.

Thank you, it's very reassuring to know you were able to get the wheel and tire refunded.

If you didn't use the tire and wheel protection during the short ownership time of the vehicle, then I might also mention that. It would be of no additional loss to them besides pushing some paperwork.
Hi Everyone and repurchase experts, I've run into a dilemma with the repurchase from Sedgwick and could really use your experience and advice. I've reached the point of approving the quote for the repurchase and apparently the funds are in, HOWEVER the cut check was based on a quote from March 2024 and since then I've made my April 2024 car payment and about to make my May 2024 payment. I asked Sedgwick about recutting a new check to include reimbursing those additional funds made, however they're stating that they can't change the quote and that I would be reimbursed for those additional payments by the lienholder (MBFS). In my head this doesn't sound right and I'm worried that once I surrender the car, take that check and approach MBFS for the April (and possibly May) reimbursement, they will decline and say that the case has been closed and settled and I won't be reimbursed for the funds paid from that March quote until surrender date. My question is: Am I overthinking it all and this is how it's supposed to go and to proceed with the surrender and then request the additional funds from MBFS after relinquishing the car?
As always, thank you all for your help and guidance.
