Carfax / Dealer / Issues

Hello all, I recently purchased a 2022 g63 CPO. The dealer sent me the Carfax that showed that they replaced the brake pads and rotors. As it turns out the rotors where never replaced. I contacted the dealer and they stated that the never replaced them and can correct the Carfax. Do I have any recourse in this situation? If its reported as work done on Carfax it seems like that it should have been done. Has anyone ran into this?

Wow - never heard of a situation like that. Where are you located? In my state, anything that was part of their disclosures for condition and work done to it can be grounds for a problem for the dealership. That being said, would potentially involved our States AG’s office, or private attorney, IF…IF…IF they didn’t take care of it properly. I recommend seeing what consumer protection laws might support you, and use those to push back. If you can sight them in an informed manner, but tell them you don’t want to have to go there if avoidable, maybe they get those new pads put on as they should. I suppose another alternative, is them refunded back the cost putting pads on it so you could take it elsewhere.

Another possibility with it being a CPO, if they don’t budget, reach out to MB directly. It’s their dealership network. They might be able to intervene as a good faith gesture. I have seen that happen with Lincoln’s.

That’s many 2cents of advise. Sorry you are going through that. Pretty crazy!

Did they send you the Carfax before you purchased the car? If so you could state this as a reason for purchasing the car at the price you paid. I find it interesting that the dealer stated as changing them in the Carfax sold you the car and is willing to change the Carfax vs just giving you some rotors...and also they they did not see the error vs their VMI. IMO its best to ask for both a Carfax and a VMI. While they may not print the vmi for you, they should share it.

The lesson learned is that carfax is not always correct and if you check it vs other sources, you find more info to make your decisions.

The carfax was sent to you by them to show you the cars history. It is typically taken as the gospel truth and forms the basis of the price they set and the price you paid. I would demand new rotors or a refund based on their obvious misrepresentation of the car. They are responsible for the contents of the carfax. They knew what was in the document. If they refuse consider posting a negative Google review and or a complaint to the BBB and state consumer protection agency.
