Landmark legal case
Unlike many other countries, Australia has no lemon laws. But now legal precedence has been established in Morphy v JLRA (Vic C & A Tribunal). Essentially the legal argument focused around ' fit for purpose' pertaining to vehicle reliability and towing a horse float. The stakes were high. Had the plaintiff failed he would have incurred legal costs of $300k plus.
I suspect car dealers are now going to think twice brushing off consumers if a new car reliability becomes the salient issue under ' fit for purpose.
Those Australians thinking of a class action pertaining to tyre wearing and brake noise may need to reconsider as such characteristics do not impact ' fit for purpose'.
