For the US, video is likely somewhat easier from the legality perspective. Audio is tough in two party consent states due to wiretapping laws. Having that said, they could probably switch the responsibility to car owners, making them explicitly opt-in or something.

@jtjbt20x and @stktyz33 are absolutley correct. The dash cam is recording public events. When in public, there is no privacy. However, when inside a private vehicle, then one's comments and actions are no longer public, and one can expect those to remain private, unless they consent otherwise. Furthermore, some states require 2-party consent for audio recordings; while others do not. I live in NJ, where only one party consent is required. However, the "one-party" can be the party making the recording; therefore the law is useless.
I wonder how uber and other ride-share services get away with it. Must be some fine print when you sign up for service.
