Paint chip/scratch defect on new gls450 2023

Hi, i was sold a brand new GLS450. Turns out there was a scratch/ chip defect on the rear RHS wheel archer on the fender. I noticed it after 1 week of ownership. They tried to do a minor paint touch up but its not the best. The only other way to fix it is if i have the whole panel resprayed.

I found out that they knew about the defect and they still sold me the car.

Now I have asked for compensation (complimentry 5 years service package) i was told to contact mercedes head office.

What should I be expecting and how should I deal with them. Its a $198,000 brand new GLS 450. Based in Australia.

If you have evidence they knew about it and the repair is not acceptable quality - surely you just return the car and get your money back. They have misrepresented it.

i’d get some professional advice (relevant to laws in your country) and go in with a well researched confident position - they’ll be much more reasonable if you know your rights.

Fobbing you off to Mercedes head office is pathetic, and if it were me would just increase my determination. Sounds like Mercedes brand and pricing with Lada service.

A good paint and body person could do that with touch up, airbrush, wetsand, and polish that you won't be able to tell. A painter could probably pick it out if you told them to look, but you won't know. Them saying to repaint the panel means they don't have confidence in their people or are trying to scare you off from having it repaired. They certainly need to loosing the bumper and separate it so they don't paint the panels together causing issues later.

If they sold it to you knowing it had the damage, that speaks very poorly for how they conduct themselves as a dealer. Mercedes should certainly know about it, but I doubt they will do much to compensate you unless it can be proven it was done before delivery to the dealer. Based on the limited information you have given about them, I wouldn't expect much from the dealership. I would consider finding a reputable body shop in your area and get an estimate to repair this correctly as well as an explanation of what they would do to repair it. That will give you a $ value you can show the dealership and use to push (don't forget to add rental for an equivalent vehicle on as well).
