Check engine light problem

My issue is that my ml320 (W163) , the check engine light DOESN'T come on at all. I've checked the bulb and its ok, but it still doesnt come on when the ignition is on for the initial start, all of the other idiot lights are on. I've check the codes with a scanner and nothing shows up. It is disconcerting because I've had a situation when the cps died and there where no dash indications apart from refusing to start, an obd scan revealed the cause. Any ideas why the light will not come on? I've checked fuses etc.. is there any thing else I should be looking at?
