E Brake?

This morning my wife called me from her ML320 (1998) and reported the brake (ebrake) light was flashing and the truck was beeping. I could hear the beeping, it was constant. She had made sure the ebrake wasn't engaged and had already shut the truck off and restarted to no avail. She also reported what she thought was a smell from the brakes. She said the truck didn't seem to want to go as if the brakes were on. Thankfully she was close to home and managed to drive slowly. She told me the symptoms just stopped and the truck drove normally. When I checked the truck several hours later nothing seemed wrong at start up. No lights or beeping. I did a test drive and found it would not upshift. Back in the driveway I too noticed a faint odor but to me it smelled like trans fluid. I've read around here and found some stuff related to the beeping and warning light but nothing mentions sticking in low gear... Also I have noticed the abs/ets lights coming on now and then and were probably on when this stuff happened today. Brake fluid level is ok and pads are near new. Any suggestions are greatly appreciated. Thanks.
