Confusing climate control problem.

Confusing climate control problem.
Hello all,
I have a ML 270 CD1 2003.
the climate control was not working when I got the car.
it only blew hot air and non of the controls other than fan speed seemed to do anything.
I changed the 3 dial control unit for one I got from eBay.
now I can set all the climate function perfectly, accept when I'm driving? If I need to turn the temp from hot to cold or cold to hot, I have to turn the engine of and restart the car before it will do anything?
the same applies to temp change with the cold or hot fields. IE turning from 22 to 26 degrees centigrade does nothing until I stop the car, turn off and restart.
any help or advice would be much appreciated.

Thank you sooo much.
I have a crap Chinese reader the doesn't read anything to do with the aircon.
I'll spend the money and get a decent tool for the job, hopefully that will work.
