could it really increase the horse power? is there any draw back to the engine?

Unlikely. The only way it would give a perceptible gain in performance is by making your wallet significantly lighter.

Not worth the hassle / risk....

marginal if any improvement - and could actually be detremental by changing the air intake resonant frequency.
If you want more power, by a super charger or ML55 - better still, buy both ;-)

Actually a cold air intake is pointless. You won't get any HP gains, and you'll just sucking in more HOT AIR. No Cold Air will go through, the stock airbox does just the trick, you want some bang for the buck, get a K&N Air Filter. It'll be so much more worth it. CAI and ML's don't mix, unless it comes from an exclusive tuner with numbers and figures to back it up.

Show me dyno graphs and then I'll believe in CAIs, other than that its useless for an ML, you won't experience any noticable gains, except sound levels from your engine and exhaust.

Why are you turning this into a bashing thread? All Im saying is that I dont believe in them, and unless someone gives me dyno graphs (ie a respectable company who makes these intakes) then I can believe in them. Injen and AEM give dyno charts for many of their intakes, so whoever is making these intakes, I'd like to see a graph myself to become a true believer of CAIs. That is all im saying.
