Tint tickets on your CPO?

I agree that they should not sell it if it was tinted too dark, but in some places dark tint is common (even if illegal).
Tint laws are by state, did you buy it in-state?
Some dealers offer tinting services on front windows, tail lights, etc.
In my opinion, pay the ticket (its not much anyways), leave the tint on (will look better than no tint).
The waiver basically said that I understood that the tint may not conform to state laws and I don't hold the dealer responsible for any tickets, fines etc.
I guess I have been lucky because since 1999 I have had SUV's and always had the front windows tinted to match the rears and never once got a ticket or warning in or around the NYC area.
Now in my cars I have been warned maybe twice in 15 years but never given a ticket, I usually never go lower than 35% tint on the cars.

Also, dealerships and professional tint shops cannot be given a ticket for tinting your windows beyond the allowed state limit. The liability sits with the owner of the vehicle, even if the tint was applied before they purchased the car, or even magically shown up without them knowing.
If the ticket really bothers you a lot, you COULD have the tint removed from your vehicle. You could then try to explain in court that it came on the used car you purchased from the dealership, and that you didn't know it was illegal. That would be your best shot.
EDIT: After browsing on Mercedes Benz Manhattan (bigger NY city dealership I could think of), there are many CPO's for sale with front windows tinted. Yours doesn't seem to be a special case. AKA removing window tint isn't part of a CPO inspection or anything.
