CE light associtated with running out of diesel?

I am looking at buying a 2010 ML350 Bluetec with about 50K miles on it from a "mom and pop" used car lot. Took it for a drive, and it had a CE light on. I asked the salesperson to let me know what the CE was refering to, and they gave me the story that "someone" had run the vehicle out of diesel, and that the light had come on, but that it was an "unspecified code." They assured me that the car was still under MB warranty (at over 50k miles?), and that they (MB) could correct it. Does this story stink to anyone else out there?

How about just this dubious "unspecified code," whether related to running out of diesel or not?

ML350 Blutec
They only have a 50k warrenty and if your over that your screwed. Have a ORielys or Autozone check the code before you purchase, it could cost you big dollars. I have a 2010 Blutec and nothing on them is cheap to fix.
