ML 350 Transfer case

Hello all,
I've just got onto this forum to find out how many people have had trouble with the transfer case in their ML 350 ( W164 ).
I complained about a vibration/quivering in the vehicle when driving off. I had only done just on 46,000 k's and it still had a year and half to go before the warranty ran out.
MB connected it to their diagnostic computer and it said there was nothing wrong.
But just after it had ran out of warranty. The transfer case catastrophically failed. This indicates that their diagnostic process is " NOT FIT FOR PURPOSE "
It ended up costing a lot of money to get it back on the road.
Now I am taking MB to court to get my money back.
Simply because I complained about it when the vehicle was still in warranty. And they did nothing about it.

Go and get them. They do this all the time.

1st time I've heard of a catatrophic failure on the transfer case, Most common issue is a stretched chain.
Otherwise it's usually the front diff.
