2011 ML 350 Bluetec engine ceased - Bad Luck after FM recall?

My wife had an 2011 ML 350 Bluetec 170k km. Original owner only dealer serviced since 2011 (except for seasonal tire change), I've driven it once in a while as I have my own vehicle. Very stable car have had zero issues prior except for consistent "engine light on" since Sept 2020, engine light would just come on and off, sometimes dealership figures it out other times they dont anytime it went on we would take it in. October 2021 my wife pays for a voluntarily full inspection to see if car is worth still investing in (as 2019-2021 was decent amount of investment in truck), dealership claims cars in great shape even goes as far as to state "let me know when you willing to sell", which seemed odd as its 2011. We took it in for FM recall Mid Aug 2022, the truck was at dealership for 5 weeks, they claimed parts delays, covid, production supply chain etc..., we weren't hugely inconvenienced since they gave us a loaner. All to say we get the car back finally but had to return to the dealership 3 times for various issues 2 of which were notably the engine light on again and a burning smell. 7 months later take the car to the dealership again (3rd time) as there is crazy loud banging noise coming from the engine, service centre states "engine blown, bad luck, too expensive to fix". Spent extra money took it to another garage to diagnose what was issue as we didn't accept the explanation it seemed like something was being swept under the rug, mechanic said he would have the take engine out which would cost 800$ or more, there was a crack in the engine near cylinder 2, talked to mechanic and explained extra warranty from field measure if anything would be applicable, he said this probably won't be covered, and dealership after years of loyalty basically kept stating bad luck, so we are taking them to small claims court. Sold the ML to the second mechanic for practically nothing, including him diagnosing the probelm. We spent about 400$ per month over 36 months (15k total) prior to its "death" for various issues some including FM recall stuff that wouldve been replaced, overall this amount seems seems high (analytcially avg per month) . Anyone can weigh in on what their thoughts are or if FM warranty would've covered anything with the greater value of the extended warranty or is it only related to emmission based parts? Ive been told 170k Km is nothing for these vehicles (unfortunately I'm not a mechanic even though I was raised in mechanic house hold, which I know regret not learning more.) I also read something bout the bluetec om642 engines seizing night and day on the field measure class action settlement thread. Thanks for any advise in advance.
