We will get a refund. You can get a refund or a new vehicle. We were advised to take the refund. It was decided thru a hearing thru my state's lemon law.

I did it without a lawyer
also had receipts for 11 oil changes,new door sills, window tint, chrome mirror covers, and lots more things i put on the car,,,got ALL my money back.. they charged me $1456.00 for vehicle use,, I got the last laugh, as for oil changes and all i spent on the car, they paid me $236.00 over what i paid for it,,this was over the 1456.00 they deducted for use.
the only thing is it took a year,, and you are not suppose to stop driving,( I parked the damn thing, after 9867 miles and made them pay for all the extra things,, Oh! the wheels i had put on i bought used for $550 they had to pay full retail $2379.00 , a lawyer will not fight for things you do to personalize your car

Every manufacturer occasionally produces a vehicle short of the normal quality and with problems. The "Lemon Law" statutes are a tremendous advancement for the rights of the consumer. I congratulate you on your well earned success.
I do though question whether it is good form to brag on a public forum about demanding and receiving more money than you actually paid for added items. It does put a shadow on the process you followed.

I didn't ask for anything that I didn't pay for. I just had window tint. But they did pay for milage to and from the dealer, parking at the hearing, my prepaid maintenance and extended warranty and MBrace service. I'm not asking for my Sirius subscription since I got a special for 6 months at $14.00 and have already used 3 months up. I won't make any money and will have to pay for usage. But that is the fair thing to do. I do however have to pay my lawyer but to me it was worth every penny.
To be honest I was surprised that MB just didn't settle. Now they have a lemon on the title. My guess is that the car will be shipped overseas or to a state that doesn't require lemon on the title. But either way I don't have to worry about it.
I will however continue to use the vehicle until I'm directed to return it.

2 years ago, I was looking for used C63, and I found some listed well below others with "Lemon" listed in carfax report along with multitude of problems. They definitely are not destroying them.

I think that crushing the car would be a sin. All they need to do is fix it and it will be a great car. But fixing it seems to be the problem and the reason I got my money back. Seems they can't fix it.

Back in 2006 I purchase a "lemon Chevy dually 3500" yes... a "lemon" remmember save $10,000 off the MSRP new was close to $60,000 got it with factory warranty, back in 2006 this truck never have any rebate or discount, dealer have to disclose problems & service done before I purchase the truck, was a overhiting problems... well I got it with 9,000 miles, I toll them if I see any overhiting problem I will fight a "double lemon" the first 6 month I have my eyes always looking at the temp gauge... pull a 15,000lbs 5th wheel, never have a single problem, Truck run like a champ till today, 7 years later.... the only bad thing is title state "lemon" of course... but I never have any mechanical problem, just oil changes, Diesel filter and air filter... I know was a gamble but I love my "lemon" truck

IMO my issues were easily fixed. However, MB didn't even try. They just kept saying there was no problem. But once the board inspected the vehicle MB credibility was gone. I won my case on 2 issues and it was unanimous on both.
IMO, the MB exec and their lawyer relied entirely on what the dealer said. They never checked it out for themselves and when they were proven wrong they all lost their credibility.
Its like one person lies and they all swear to it. Even without verification.
But its over and I'm happy with the outcome.

First advice is NOT to get a lawyer. If you get a lawyer they will take a HUGE chunk of whatever your final settlement is.
Car makers do not want to involve a lawyer, it costs them more money.
DOCUMENT, DOCUMENT and DOCUMENT some more ALL the issues and take photos (if applicable).
I just went through a lemon law process with JEEP and they took back my 2011 and gave me a better model (2012) (went from Sahara to Rubicon) and it didnt cost me a dime. The whole process was done through a mediator group called impartial services.. The car maker will try and stonewall you and give you the run around. Just be persistent and did I say DOCUMENT everything?
Get a lawyer only a LAST resort.. after you have made a gazillion calls and written letters. Chances are you wont need one..
