Our diesel engines have enough issues without creating more; I'd get .6L vacuumed out and enjoy having the correct level of oil in the pan.
Why did he put in the extra?
Oil in a diesel oil turns black pretty much on contact with the engine internals.

i just went to mechanic and he told me the proper way to measure is to turn off the engine wait for like 3 min and than measure it and he did measure that way and the oil level was perfect up to the max .. he told me not to measure in the morning because the oil dries from the filter during the night and that way has more oil.. after he measured, the oil level was up to the red line. but i didn't take a picture.. what do you guys think?
the oil level was up to the red line
the oil level was up to the red line

Let me see if I've got this correct: you've got an actual mechanic telling you its OK but you want the random advice from unknown posters on an internet forum to confirm or deny your mechanic's advice.
You should do whatever lets you sleep through the night. If it was mine I'd drive it. But what do I know? I'm just another random goof on the interweb.

This is what i found in the manual so i guess the mechanic guy has right about how to measure the oil level
Depending on the driving style, the vehicleconsumes up to 0.9 US qts (0.8 l) of oil overa distance of 600 miles (1000 km). The oilconsumption may be higher than this whenthe vehicle is new or if you frequently drive athigh engine speeds.Depending on the engine, the oil dipstick maybe in a different location. When checking the oil level:Rpark the vehicle on a level surface.Rthe engine should be switched off forapproximately five minutes if the engine isat normal operating temperature.Rif the engine is not at normal operatingtemperature, e.g. if the engine was onlystarted briefly: wait about 30 minutesbefore carrying out the measurement.

my 2013 ML350 bluetec takes 8 liters of oil. Not 8.6.
It could also be said that my 2013 ML350 bluetec takes 8.5 QUARTS of oil.
This is according to the owner's manual, and correlates to the AllData info.
I can't imagine yours is different, but as they say in the funny papers: You do you.
Note that the 550 and 63 take 8.5 liters (9 quarts)

Random goofs on the interwebzes say they always keep it between min and max so oil doesn't get sucked through the crankcase ventilation system and into your intake manifold. But if the authorities on motor oil say otherwise then I guess that's what you'll have to believe or they might sanction and/or shadow ban you for spreading misinformation and disinformation.
