Active Headlight issue

Active Headlight issue
So I am moving this threa over from the electronics section since it says that this is moderated by an actual tech. So I am hoping here someone can give me some good solid answers on what I should do.
I have an 05 E320 with the active headlights. Just starting the other day, when I would turn the car on, day or night, I would get a warning saying that the active headlamps were unavailable. Sometimes it works fine, but more often than not, it gives the error. What is funny to me is that it does it even during the day when the lights do not even turn on. I am pretty sure the stepper motors are functioning because during the times that it does work it works great. Just either randomly during my drive or right when I start up I get the error and then no movement at all. Also at night, the lights do that little up down calibration thing and center themselves but then I get the error. I am royally confused on this one, especially since it happens during the day. I would understand it happening at night and one of the position sensors does not work, but I thought that the lights dont move unless the lights are on themselves. If this is the case then why do I still get this error when the lights do not even come on?
Also, if I cant get this resolved soon, (and cheap), is there a way to disable teh active headlights for the time being?
Any help would be great.
