shifting issues and power steering

so for the past few days my 04 clk320 was having issues switching gears, espsecially in lower speeds. It seemed that it was jumping gears, especially around 15-20 mph when it felt like it was an 5th gear (sounded like a manual transmission about to stall due to such low rpm's). I brought it into the local dealer, figuring I have a GE 5 star warranty that should cover it. They run a 100 dollar diagnostic on it. Tell me its because I dont drive my car enough (about 6-8k a year). They say the solution is to "take the long way to the grocery store" and/or buy a trickle (sp?) charger and charge it every day or every other day. They charged me some more to reset some electronic stuff and then I went to go pick it up.

I go to pick it up, and it seems like my power steering isnt working. It takes alot of effort to turn the wheel either way, especially on a hard turn. I called him right after I picked up the car and he said to call him today. Still waiting for him to return my call! My question is:

1) Is there really no fix for my original problem? Has anybody heard of such a situation. I am planning on selling my car in a few months ---who would buy my car if I tell them they have to put a trickle charger on it every day lol

2) How should I approach them about the steering? It certainly wasnt like that when I dropped the car off. I didnt clock in the miles before I dropped it off, but they might have driven it in order to check on the problem that I reported. Should I be expecting them to pay for the repair or will they likely say its not their liability?

thanks for the input guys
