memory seat irritation

I have a 2009 SL550 and the seat doesn't move back when the car is turned off. MB said they stopped this in 2007. I am using the memory "3" position for this exit position. My problem is that I have to hold the button for several seconds to move the seat to this position and then when I get back in the car I have to press and hold the number "1" button to get it back to driving position. Has anyone found out how to fix this irritating problem. Someone told me that MB in europe don't have this problem.

My 2005 has the easy exit. One tip, if your normal seat position isn't far enough forward, the seat won't move back when you open the door. Try moving your seat further up then open the door.

This is designed to make you hold the button so that the responsibility of moving the seat is yours and not the cars........might be something to do with some peoples tendency to sue anyone when they get injured by something they are operating.......also why many other functions are different in North America compaired to anywhere else in the world.
