Breaklight switch failure but break lights work?

I'm getting a break light switch failure in my w208 but my break lights work, also have the abs/esp/bas lights on the dash. I was messing with the switch and I noticed a wire tapped into one of the wires connected to the switch I traced it back to the right break light. Not sure y the previous owner did that. But will the break lights work with a bad break light switch?

The brake light switch has 2 physical contacts within it. 1 set operates the brake lights and the second tells the ABS that the brakes are applied. the ABS/ESP control units monitors both contacts, if they don't both do the same thing at the same time it logs a fault. That's how it knows there is something wrong.
