Touchpad acting odd

Touchpad acting odd

So I noticed yesterday that my touchpad is randomly working. It seems to work when I have the car in economy mode and not sport. Not a big deal as I typically do not use or like the touchpad but found this odd. Does this sound like a SW issue or HW?

Free under warranty – factory or extended. Out of warranty request MB goodwill repair, software update required to correct known production problem documenting codes 805 (2015) & 448 (touchpad) both of which apply to your vehicle.
