Anyone have recent Calif. Lemon Law experience?

2020 S560 Sedan, 2019 SL450, 2019 E450 Luxury Trim Wagon, '24 BMW I7 on order...
Anyone have recent Calif. Lemon Law experience?

MBUSA has offered to “buy-back” my 2020 S560 due to a rough shifting transmission. The car is now about 16 months old. The buy-back was offered In May of 2021 and is good until September of 2022. My question is, how much should I expect to get back? The car is leased through MBFS. Does anyone have any recent experience with the California Lemon Law?

A friend bought a 165k CL 600 back in 2007. He paid cash and got back every cent. Tax, tag, license. His car kept draining down the battery every few days. You will get back what you put in. So, if you didn’t put much down, which most people that lease don’t, then you won’t get but that much back. I would think you would get everything back up until the point they made the offer. Anything after that, that you decided to keep driving, I would think I’d your part to pay. Ethically, if you kept driving it 6-8 months after they offered the buyback, those months should be on you.

Normally, I would agree with you. However, MB created this problem and they continue to produce vehicles with harsh shifting transmissions. They know of the problem, but have seemingly done little to resolve the issue. Obviously, the number of vehicles with this issue is small compared to the total sold, but to those of us who highly value a smooth shifting transmission—especially in something like a brand new, $131K luxury sedan—the problem is huge. So, the issue is their fault. Now, just offering to buy back the car is nice, but I ordered a new 2022 S580, shortly after the buy back offer was made, and MB has yet to deliver the car for what is now over EIGHT MONTHS. With that in mind, I do not believe the lease expense for these eight+ months should be on me.

Maybe ask them to reimburse the total cash outlay, take back the 2020, and give you a brand new 223 loaner until your ordered 2022 vehicle arrives? Assuming you still want the 223?

Or just get them, to fix it as they were legally obliged to do.....if that means a whole new transmission so be it. As you said it only seems to affect a small number compared to the number built....so most of the transmissions must be good.....

New tranny unlikely to fix this issue that is documented. It is a little more complicated being a lease vs. purchase but I bet you can get all our cash outlay back and whatever you put down, but you'll need to come up with that to drive away in new 2022. No dealership is going to give a loaners for an unlimited period there is a huge shortage of loaners and certainly no S-Class loaners. My local dealershp only used GLS or GLC's as loaners they used to have E-Class but no more.
