Most certainly speak with a local attorney.

Here in AZ the department of transportation requires dealerships to a have a surety bond last time I checked it was in the amount of $100,000. Bond works like a guarantee in cases where dealers engage in fraudulent activities in effect a bond claim can be made and used to compensate affected parties.

Assuming a court would conclude the fraud was committed no?

Would be a long road before you got to that stage.

But 'what if' dealer, given their claim of high sales, decides to remove mark up on this one sale in lieu of legal expenses.

Easily can just say they forgot they promised customer a no mark up sales situation. In the real world - it can be an innocent mistake. (Not giving any wiggle room to a dealer mind you)

And even if you don't have written proof, drawing attention to this is a good thing, so a case would benefit all carbuyers.

I would say call the news, but theres not a lot of sympathy for those of us buying cars this expensive lol

Upon review - it specifically states in writing that the dealer sets the actual price right below the MSRP price. They clearly noted that MSRP and actual price won't be the same. It's right there in black and white.

But as I understand it… Ordered in person whereas no mention of dealer setting final cost or markup verbally or in writing, claims price difference is due to taxes, etc. in an attempt to hide markup. A strongly versed letter from an attorney directly to General Manager just might convince him/her to bite the bullet on this one.

Sure they can set the actual price, but they have to be transparent and straightforward with consumers. They lied to him.

Yes, markup remained hidden till the cross-questioning was done a month later after the sale, clearly i agree, i was blindsided and should not have trusted him with what he made me sign.
There is no itemized section showing 10K premium anywhere, BBB and Mercedes North America complaints done !
Next will be Public humiliation - reviews, attorney consultation, state agencies etc.

I'm from NJ and am surprised that Ray Catena did this as they're very reputable and are all about 'customer service.' I'd speak with a higher up and see what they can do but unfortunately as you admitted you signed the contract blindly. The window sticker of the car should always match the contract price if deal is done at MSRP and everything else is usually always broken down. I wish you luck!
