There is always a capital gain unfortunately. However if you hold then you only pay when the gain is realized. With real estate you can defer the capital gains using IRS 1031 exchange. Like anything tax related always try to minimize the tax liability. With stocks unless you trade in a Roth IRA it can sometimes be harder to shield the taxes on stock. Death and Taxes are inevitable.

How does commercial real estate valuations work from a property tax perspective? Is it only assessed on a sale or major change requiring a permit?

Any income is taxed as income (rental income, etc) but gains are only taxed when they are realized (upon sale). Property taxes are assessed on an ongoing basis just like residential real estate. The property taxes go into the operational costs that can be deducted against any income as expenses.

Where I live, residential property tax assessments are only done during certain “significant” triggers, like sales or pulling a permit.

So you don't pay annual property taxes?

We may be misunderstanding the use of the word "assessment".

Here property values are reassessed every 2 years regardless of sale, etc...but we pay our property taxes every year

No I pay property taxes every year, but the amount I pay is based on what I mentioned above. The question I asked does commercial property get assessed the same way? I wasn’t sure if the county reassessed commercial property on an ongoing basis or what.


i.e., is the assessed or taxed value based on the sale amount and will it ONLY change if you pull a permit or get a loan against it? I know counties have the power to randomly reassess properties at their discretion but it’s rare without a reason.

Got it. The answer is it depends on the state and municipality. For instance here properties are not reasessed automatically upon sale or permit filing, its done on a regular basis (every 2 years) and residential and commercial are the same. Thats totally different in every state though.

Yeah, I didn’t know how commercial property tax rates worked. It wouldn’t surprise me if most counties reassessed commercial properties on a periodic basis but that’s why I asked.
