It's probably not an issue since it was revealed "while in the auction lanes". Carfax probably also has it listed this way now (I don't have a Carfax account so can't check myself).

Since carfax missed, aren't they liable for buyback?

I keep hearing carfax is not accurate but something like this happens and nothing is being done

Just a thought, I'm not sure if it applies and I don't have the complete technical expertise: A decent amount of cars that I see go through auction have the word "unibody" written on the windshield. However, (at least in Riverside), it's not "frame damage". I think that's where the discrepancy may lay.

If the car does have frame damage, then the lane will announce frame damage.

Well, I guess that's in the details of the contract Carfax offers. Since no one has bought this thing, there (obviously) isn't a claim. The claim would lie with the person who bought it filling a claim with CarFax. It would probably be only those people who know what the settlement would be so, unless someone wants to step out there and put their own money as risk, I don't think you are going to get any type of answer on this forum. Afterall, we are simply consumer's just like you. That being said, I have heard of CarFax buying a car back (or offering some discounts in settlement) so I don't think there's any great "conspiracy" going on with Carfax. Did they miss this one, Yep "I" think so (but others may differ). Could they have a claim filed by the buyer? Sure, but only IF the buyer used the CarFax services (i.e. ran a carfax on this particular car and then bought it based on that knowledge). Will we EVER find out if they did and what the settlement was, NOPE. Get over it.

I found a viable candidate. It's a single owner car but the mileage (52K) is higher than I wanted and it's a 2003 so it's a year older than I wanted. But the price is right (I can get it for $39,500). Recently had the suspension recall performed so that's covered. However, it is an "old man" color (pewter). Maybe... Let's see $20K for my TL, $39.5 for the S55. May not be so bad. Still considering it...

I decided to pass due to it being a 2003 with the CD-based NAVI as well as the mileage. It's still a good deal if there is someone looking for one on the east coast, let me know nad i will point you in the correct direction.

I WAS interested, but....

All,

I have been sweatin' the '03 S55 (and another car of Bavarian derivation) for several months now. It is hard to believe that the price has come down to the mid '30's for vehicles with 70+K on them!
That being said, the missus has put her foot down, and wants me to look for something a little bit less costly. She, being an aggressive driver, appreciates the differences between the '02 and '03, but she IS the most practical member of the house, so I may have to acquiesce. %$^^!!
So...anyone out there have a well serviced '02 that they want to sell, or know of someone that may be looking to sell? I have an offer from an acquaintence to peruse the exotic auction in Mainheim in Pa for me, but I wanted to give you folks a jingle before I go that route.
One more thing: what type of extended warranties do you people purchase when your cars get up in miles?

I thought the 2003 model was the year they switched over to DVD. I know the screen size increased. So what year did they go DVD?

2003 got the CD version of the Navi. 2004 is the year that got the DVD. As far as warranties, the only warranties available outside the dealership (private or brokerage) are the aftermarket warranties. Unfortunately, I think that most of the aftermarket warranties require the car still be capable of being covered by the original manufacturer's warranty. Since a 2002 is over 5 years old, there would not be any mfg warranty on those. In fact, most of the 2003's warranties are already exipired as well.

2003 S55 Black/Black
I bought my 2003 S55 in August with 81K miles. I purchased a warranty thru the dealer where I purchased the car. It is called Total Protection Plan administered by Prizm Aminstrative Services, Inc. One of those "only can be purchased thru the dealer" deals but it got me 24 month/24K mile coverage on all the powertrain and some other stuff. Not bumper to bumper on a car with these miles but wort it if something big goes out. It cost me $3157.00 thru the dealer with a $100 ded. I am sure the dealer made 30-40% on it but there was not any other choice for my car. It was very hard to find anyone who would cover an AMG, much less with these miles.

I just had motor mounts done at the local MB dealer and they covered them. Would have been @$1000 otherwise, so I am on my way to recouping my investment and I am sure I will over the next two years.
