Pre-safe transmission issue

Pre-safe transmission issue
I'm having an intermittent issue where the transmission will stay in whatever gear it's in and the "pre-safe" warning indicator will come up on the instrument cluster. It seems to only do it when the engine gets up to 90-100 Celsius (basically stop and go traffic conditions). I've had a short test run and the only two things that stood out were a CAN communication issue from the ESP to the ABC (although the ABC module didn't register this communication issue) and the conductor plate was getting different readings from the speed sensors.
I don't think it's an ESP issue because a few times the transmission didn't go out of fourth gear no matter what I did, until I turned the car off and let it go to sleep (instrument cluster shut off), then the car acted like nothing ever happened. I'm hoping somebody can help me figure out if it is the conductor plate, or something else like a CAN issue.
