It has a clean AZ title in case u were wondering.... and I'm only gonna ask $16k cause i bought it right and that's where i think this car should start at while leaving some wiggle for the inevitablel negotiations.

You are guessing wrong. I had 1999 MY E39 M5 with facelifted 2003 engine which have just been properly broken in when i got it (3000 miles on it). I put another 40.000 miles on it before i sold the car. All the time that i owned that car the oil consumption NEVER went below 1 liter/1000km, no matter what oil did i use. Spark plugs fouled themselves every month, and smell of burning oil after just one WOT was EMBARRASING if not just not bearable. Point is that doesnt matter much if S62 engine is FL or PreFL. Most of them (mine also) eat oil and they eat it A LOT (some even A LOT more then 1 liter/1000 km). Thats a fact. Most of E39 M5 owners just doesnt tell that loud because they are ashamed of that. Upgraded piston rings (and latter prescribed 10W-60 heavy engine oil) doesnt helped much, also. They just eat oil. Yes, there are rear case when S62 eats less then 1 liter per full service interval , but i doubt you will get one of those.
One of the things which also bothered me (and many other E39M5 owners)was loud and brittle VANOS, but that is another story...i dont even want to go there.
Lets just talk about clutch and MAF; Why do you think everyone (who not drive the car like grandmother, but like it was ment to be) swap to 850Csi clutch or aftermarket one? Because stock clutch is WEAK (remember-E39 540i share the same clutch then E39 M5-if that is not telling you enough, then i dont know...).
About MAFs: i wont argue with you about ECU tunes solving MAF problem, but it is just known fact that MAFs goes bad on monthly bases on E39 M5 (i guess, or better-i KNOW- oil in intake (because of oil consumption) plays a big role here).
Also brakes on E39 M5 are ****. We overheated them after 2 strong brakings from 100 to 40. And that is a fact. That is why big brake kits are so common on E39M5. Enough said?
About E55 being pig....For my opinion M5E39 is even BIGGER pig as far as cornering abilities...Just look at the patthetic positive camber on front axle (and even more pathetic negative on rear when car is just a little bit lowered) and it should be clear to you that front axle just CAN NOT grab enough in corners (that is the reason why most of E39 M5 owners put rear wheels on front axle to improve patheticaly bad grip of front axle but unfortunatly with not much luck). I dont even wont to mention tyre wear because of front positive camber and rear negative camber). Tyre on monthly basis (i can live with that with 500 rwhp, but not with weak 300). Also i can not stand at look of this camber (negative rear and positive front). Car just looks like someone made a mistake on front axle
One thing that also bother us is engine power. It is known fact that there are rear cases where S62 actualy produce 400 engine hp (cca 330 WHP). Most f them are arround 300 WHP, and some are even lower. Add that fact to heat soak problem (why do you think IATS relocation kit is so popular??) after 2 WOTs and you have 250 WHP car that is EASILY bitten by 300 engine HP E32 750i (not even to mention old E36 M3 with 286 engine HP). Imagine that? Daily beaten by 100 hp (and 200 NM) weaker engined cars? Just a shame.
Should i go on or do you get it?

So in the end, yeah, you are wright, i was "insulted and at the same time threatened by the question" which one is better car... Jesus And before answering to me dont forget that i speak from first hand experience (i own(ed) both of the cars for long enough time to have clear picture and on top of that i know thing or two about cars. So dont listen to biased E39M5 owners and dont listen to internet theoretics, but instead go and test try both of the cars and you will also get clear picture very soon, beleave me.

Really? Seriously?

Why would/did BMW overrate their E39 M5? That's pretty damn bad. I'm glad then they're not doing it anymore and didn't overrate their E60 M5...
