Class Action - Fuel Leak
Gentlemen,
I've been a member of MBWorld for almost a year now, joining in 2011 to research potential issues before purchasing my 2007 E63. I don't post often, but I try to be helpful and give back in a way that promotes and furthers the collective free knowledge on which I've come to rely. This issue of the leaking fuel tank and sending unit...it bothers me, and not just because I was affected, but because I worry that others, either out of financial reasons or out of disgust with MB, may not pay out of pocket for their own repair. Mainly it bothers me that they've known about the issue (at least Park Place Dallas did), and somehow it's not a recall. Now add in the environmental concern..
With my problem recently resolved through aftermarket warranty, I don't have a huge dog in the fight. What I do have is an opportunity to help a potentially large number of owners with the same issue, so that a no-out of pocket repair can be made available from MB. This is why I've decided to pursue a class action lawsuit against Daimler AG - MB USA. It's not often that I get the chance to positively impact peoples' lives, and after much consideration, I think this is a worthy cause with a very positive potential impact.
I am worried that moderators might think I'm advertising for the firm that's handling the class action, so I won't post their contact info here unless a mod says it's ok. Many of you who've experienced this issue have so much valuable input that could hugely benefit the case, and I encourage you to PM me should you be interested in contributing to the effort.
It will be interesting to see the results of the NHTSA investigation. I would imagine a positive result, if any, would bring a much swifter response than a class action, but at the very least we have this now as a backup.

Is this for the E63? What model years?
I have some kind of fuel leak right now on my MY07 E63, but it is very minor and the shop hasn't tried to figure it out yet.

It's for the W211, which I believe is 02-09 E55 and E63. Possibly including non-AMG vehicles (all E-class).

please send it to me to. my 07 e63 also has this issues and in the last 2 months I've had the sending units and fuel pump replaced and the seals replaced twice.

Like yourself I dont post here often, however i have been fighting this problem for over 3 years with this car. Havent filled this car past half way in years due to the smell. Prob over 7 dealer trips regarding this all to no resolution. Please add me to the list

Please add me as well. I have the leaking sending unit and have been holding off on paying out of pocket for the repair in hopes that this would be taken care of by MB. There are many on this forum that have paid out of pocket for the repair only to have the problem resurface a few months later.

Add me to the list. I've taken my car to MB and they charged me $50+ to tell me it is a fuel leak and they wanted me to pay out of pocket saying MB won't cover it. Still haven't fixed it.

Soooo im reading this just after leaving a friends shop...(Mercedes only). He sees my 05 E55 and walks me to the back to show me a fuel tank from a 211.
Here is the interesting part. While it looks like the leak is from the sending unit, it is not. Thne leak is in the center top of the tank and runs down into the sender pocket! It is one hell of a flaw. The only fix is to replace the tank!
Only way to diagnose is topull out the tank.
