This is great news. This problem is now being reported by news outlets which will scare MB more than we ever could ourselves. My CLS55 also has this problem. As a temporary fix, I only fill the tank 3/4 full. I hope MB will honor every vehicle that has this issue and fix it accordingly.

Makes me pissed every time I see reference to this subject. Mercedes should have stepped up a long time ago. I fixed my own rather than run the risk of fire. If Mercedes loses, then I should imagine I would get reimbursed for the cost. I still remember Mercedes trying to charge me for "diagnosing" the issue when I clearly told them what the issue was. They tried to charge me over $100 to say "It's likely your fuel sender that is leaking, we can replace it for you, but the problem may not necessarily go away, can't tell until we replace it .. It'll be $1000+ to replace it …"

Mine's in the shop now getting a fuel sender. The previous owner had it done a few years ago, so second time for this car.

Couldn't agree more. Jalopnik or Autoblog would give this issue a lot more exposure. We need to get them the list of affected owners that we have here, the lawsuit PDF, and the news story. I'm sure they could write something up.

I recently had a check engine light come on, and I had my Indy run the smoke test to find the issue because the code was fuel system related. It was diagnosed and fixed and the problem was a dried out gas cap. However, I smell gas when I put my nose to the rear wheel well on the passenger side. Now what?
Is the fuel system a closed system or is there a vent? If no vent I better take the car back to Indy!!!

Beast now going back to Indy today to investigate the smell of gas under the rear seats. See thread posted about channel 2 news in Atlanta and there exposure of the SERIOUS fuel system problem these cars have. Any local CA resident considering filing suit and or seeking counsel please let me know as I am looking into it. Have a good day Gents!
