Ok......Have you talk to a Mercedes Tech or Service Advisor about this issue. It's obvious that our cars hold 9.2 - 9.5 quarts.
I know that when I do an oil change, I always add back more than I took out. It's always better to have a little more, than less.
If you put in 9 qts, then you are fine, until you get this issue diagnosed.

Unfortunately, I know this answer all to well. And that is why, I never take my car to Mercedes, I have a good friends that have their own shop that I take my car to.
Their service is excellent, and reasonably priced. And I've been going to them for 15 years.
