You have no deductible at all when it comes to damages caused by the other driver. The at-fault driver is responsible for your whole bill, even if that includes custom parts. You were not required to have extra coverage to make the other driver liable.
Again, the other driver is liable for the LESSER of the repair cost or the reduction in value of your vehicle, up to a total loss. So if your vehicle is worth $10k and repairs would be $12k, they only pay $10k.
When you make contact with the other driver's insurance carrier, be sure to ask for a comparable rental car to cover the period they are doing their estimates and/or repairs.

I'm crossing my fingers and taking your side (...hoping that all will be covered).
I already took a rental car the same hour i dropped off the car. Insurance covered it.
Man cars are getting expensive to fix. Sure doesn't LOOK like 9k in damages. Doesn't look good at this point. Although I had a Camaro that was totaled and est was 6500. I took the money and found a place to fix it for 3500. They really jack up the prices on the insurance quotes

I'd spend that on a prime rib dinner as well.
It's an '04. "IF" in case it is a total loss, I'm not financially prepared for the next move.

This place is a joke.
An '04 E55 is basically, a $12k car nowadays, erring on the high side... I'm not sure what the insurance company thinks it's worth but I guess you'll know soon. I'm surprised the at-fault adjuster hasn't looked at it yet.
KBB by the way, is a pricing guide created and written by the dealer's union (NADA) to benefit the dealers. Insurance companies and banks have their own pricing guides. Don't expect too much for your "mods" as typically they decrease value, regardless of what you paid out of pocket for them, or what they are worth to you. The insurance adjuster may offer you a little more than the car is worth to settle the claim, if it's totaled. The adjuster will be most interested in settling your claim in the fairest, and fastest way possible- which sometimes means totaling a borderline case.

You can file against the claim if it comes out low. They will have to send you comparables for sale at their claim rate. Also I would strongly urge u to buy the. At back. Usually cost 2k or so. Yes it will have a salvage title. But mods engine and parts are worth 6k or more easy.
Man that estimate made my stomach hurt. I feel for you. If they total it out, hopefully they'll come back with a number on the high end of the scale. A buyback could be a good option.

This place is a joke.
Some knucklehead pulled out in front of me without looking last month..he received a citation and his ins. co. paid for my damage. I averted disaster and slammed on the brembo's.....turned the wheel left, mitigating most of the potential damage...The right front fender, headlamp assembly, and bumper (repair) was a $2000 estimate from the ins. co. itself. MB's are not cheap to repair.
$7200 is what the insurance gave to me after a deer commited suicide. I gathered all used OEM parts and saved $$$$. I actually out money in my pocket. Used one of the best shops in the nation too. Hope it works out for you my man!
I own a huge body shop. I can get you wholesale on the parts and ship them to you. If your local I can fix it for a fraction of that. All I mostly fix is high end cars and get huge discounts on factory parts. I can have them shipped to you as well. Sucks when it's somebody else's fault! Your replies made me laugh and look at your other post and came across this. Just let me know if you need help

Since insurance gave you that amount, what was the result of your title afterwards?
Really sorry to hear what happened about the deer. I guess the deer went "towards the light".

The last set of updates from my insurance company was kinda' like this...
"At this point, the other party at fault has accepted full liability. They're willing to pay damage costs. As far as the amount... that's to be determined once the shop finds 'all' damages."
My adjuster said that he thinks everything will work out well. With that said, I called the shop on Friday afternoon and he said that my adjuster hasn't reached out to him yet. The shop owner said that in the meantime, send me information on all the mods you want back on the car. Have it set up easy for me so that i can get them for you.
I should find out more information this coming week.
Yeah, I need to have the shop owner include all the costs on his worksheet to bill to the other party.
My epic mistake was not saving all links / names / companies / references for some custom mods I've done in the past. Trying to find my previous sources isn't easy now.

wow bro..... so sad to read this and the worst part is that i exit El Toro on a daily basis. Knowing me i would've pulled over and share the pain w/ you bro. I'm going to stay positive and say your beast will be back on the road ASAP w/ no issues w/ insurance. It's not going to get salvaged! let me know what i can help with bro.
Your insurance may not cover mods, but YOU didn't wreck your car, someone else did, and THEIR insurance doesn't get to pick and choose what mods are covered or not. Find comps on your car base on age, mileage, mods, and condition. THAT is the value.
You can stand pat on that number for repairs, without them being able to salvage it.
It is a different negotiation when someone else drills your car, compared to when you do it yourself.
What are you coming up with for value to replace? you can also when taking the total loss, demand that they replace the car with the comparable one of your choosing, including transaction costs, maybe even you can get them to give your own car back for parts, depending on how well you negotiate.

I'll have to see your car in person sometime

Thanks man... i really do hope all works out well till completion.

As far as value, I found some really really nice stock ones around low to mid 20's. That's only cause the night of the accident, I started "wondering" what other E55's are out there for sale. I came across a white one online going for $23k. The car was effin' immaculate. White exterior, black with burgundy interior, and the best part... 37k miles!!! Based on the pictures, it was so clean inside and out that it was unbelievable.
I'm going to do what i can to make sure that all is taken care of (...the right way... the heavily modded way).
Wait what?!? You're out here too?!?

You do have a good point.

Sadly... that unicorn isn't located in California. I purchased my car out of state, so when searching for other E55's, I didn't limit myself. I apologize but i don't recall which state it was in.

Wish you luck but last July I was hit and not at fault. Fought from Jul to Dec on payout. In the end I only got $21k for the car. All I challenged was met with "that's a personal preference". I had $30k in fully documented mods. Got $0.

Aww... bro. I never knew.
I'm really sorry to hear.
I'm just hoping that the process continues to go smooth.
It's not over, until it's over. So we shall see.

Wow... random update.
Received a call from the shop who said that he can't find an OEM E55 bumper from any dealer.
I called Fletcher Jones in Newport Beach and guess what the parts person said... "unfortunately, our entire database shows that there's nothing in the world. Meaning, west coast, east coast, and Germany."
Major fail... it's just one thing after another. Geez.
If worse comes to worst, I'm gonna grab a W211 E63 rear. However, will the center lower section be a problem for my diffuser to fit?
Argh!
