CPO - Tires

Flew to dealer on 8/27/21 purchased a CPO 2017 E400 luxury wagon, car had 39,185 miles. Drove it home 493 miles, drove it another 681 miles before I could get the State inspection. The car passed inspection, Mileage 40,359, but the dealer mentioned that I should think about replacing 2 left tires before the winter, (live in snow country) as they only had 4/32nds of tread left. The right-side tires had 6/32nds.
Per Mercedes CPO inspection:
Item #77 - Tire Wear (Including spare); Min. Tread Depth = 5/32 in. NOT including TWI; Record tread depth. Replace Tires and Spare regardless of remaining tread if they are older than 6 years
This only hit me the other day when my son was buying a car from Carvana, and they were expanding on their inspection process, and he asked me what a new tire tread depth was, I told him 10-11 32nds. Which got me looking at the paperwork I received from the dealer, which did not include their inspection and I do not remember signing off on it. Per Mercedes documents I should have received a copy.
"What This Report Means to YouYour purchase of a Mercedes-Benz vehicle demonstrates that you possess sound judgment and impeccable taste. This report shows that your newly acquired pre-owned Mercedes-Benz vehicle has been inspected and when required reconditioned to our exacting standards."
So, before I contact the selling dealer, I am asking for your thoughts:
Should I:
1. Forget it, and just get the tires?
2. Ask the selling dealer to replace the tires?
3. Ask the selling dealer for some $$ compensation.
I take the CPO inspection very seriously, I paid for it!
HEck ya might get a few bucks to help pay for new tires...
To me, CPO is just paying for that extra year of warranty.
The inspection is a farce from reading on all the disasters on here...
Really depends on the inspecting dealership and whether they take pride in their work and the CPO seriously and are a "GOOD" MB dealership
