So does that mean the transmission is physically damaged or be considered as abused?

I wonder if MB should had limited the RPM and specific break-in guidelines through software so people have to follow the break-in as the computer won't let the car go beyond the conditions set prior to break-in being completed. I see some form of this in place for example race start not possible but is it too dangerous if say they limit the engine to only 4K RPM through software until break-in is done, say for passing or get out of a dangerous situation?

No, just not properly adapted. Best approach if OP indeed didn't follow the break-in instruction would be to reset the adaptations and then follow the break-in instructions for the next 1000 miles. Basically do it over.

That would be a liability in case of an emergency.

The car was unbearable to drive in traffic. I've already had the second update and adaptation done at the service center. It helped for 5 minutes.
The service center told me that many models have this problem.
