yeh, im gonna be honest, it isnt in "Extra Clean" condition. i would say its between clean and average. the interior has a couple coffee stains and its a little messy cuz of all that dirt, sand, and dust that collects in the edges and stuff. the paint has some swirl marks and a couple dings. absolutely no mechanical/engine problems though.
we were going to sell it for $9000 at least (private party) but we changed our minds, went to the dealer for a trade-in of half of that, and just decided to drive it until it stops moving

I am taking your advice Big Terry. I filed my complaint with eBay today and I am still looking around for good Lemon Law lawyer. No money and I don't think they will pay. I think they are playing some games; the dealer won't answer the phone when he sees my Phone # in Caller ID. I mailed back the title to dealer after our last conversation yesterday and I wonder if he going mail it back or just keeps the money and the title

yea.... bad thing to do. he can always rewrite the dealer name on the title and make a fake copy of the Bill Of Sale and have the car repoed or stated stolen. these arabian ppl are just money hungry.
ummm. wanna break into the mail rooms to search for the title? lol.
oh and i took a closer look at the pictures on his ebay page. i do see the front bumper flaws, missing cassette trays and hangin buttons on the radio. so you prolly can't say much about those in court. but the rear wreck, thats where u can get him. try not to mention minor stuff like the chip on the windshield because he will use minor wear and tear against you. just go with the big things like the wreck and i guess u can state the front bumper

this is a typical breach of contract / false contract case. any lawyer could easily win this.
Given it is over $5000 you can go to court and not small claims court.
And, the dealer can possibly lose his license...

Very good points fast mayte. My question now is where to look for a lawyer? Is it better to find one in my home state (Arizona), or the dealer home state (New Jersey) or makes no different? I am still waiting for ebay to respond to my complaint.

Read your bill of sale
Your bill of say might say which state (jurisdiction) you are required to adjudicate in. It might also state that you are required to use binding arbitration to handle disputes, and not go to court.
It pays to read all paperwork before signing or agreeing to a large $$ purchase.
If you have a restrictive Bill-of-Sale, you sill might want to get a local Attorney to send nasty letters to them and to file in your home state. Makes them know you are serious, if they get a letter from an Attorney.
Many people treaten to get an Attorney, few go through with it. Also follow up with all the govenmental authoritys mentioned previously.

Check out the e-bay....
Did the dealer list Terms of Sale or other "legalese"? Are there any e-bay "Terms of Sale"? Bills of Sale at a Dealer fills the back of a Bill of Sale. If the business you bought it from is an auto dealer, it is hard to believe they didn't wrap them selves in a bunch of "terms of sale" protections.
Addenndum: Well I found your link to the e-bay offering, and there is nothing about which juridiction you have to bring suit in, so you should be able to argue that since you are in AZ, and bid in AZ, AZ is the state you could bring suit in.

Do you belong to a union that offers free legal service as a benefit? Are you a student at a college with a law school that you could see if someone there could write a letter? Do you have a benefit at work of a free legal service that would write a letter for you? Do you have a friend, relative, spouse or child that is an Attorney and would be willing to write a letter for you?
