What gets me is that MBUSA is offering you a used 2002. Maybe you're willing to settle for that. But, I'd press for a NEW, 2003, at ZERO cost to you. You may have to pay some taxes and registrations, etc. but that should be it.

) If you've had the car for 18 months, you have received some kind of use out of it (or loaner cars), and that is worth some money. Most states have a formula to quanitfy that value. I would look at the formula for your state and see if it works out better that way. As much as you would like for it to happen, you will not come out with a new car at no cost. You will come out with a new car for very minimal cost. Good luck!

If I sold my car on the market ($37500) and turned around and paid top dollar for a new one ($41000) then I would only have to spend $3500 out of pocket.
I have researched the lemon law and consulted with an attorney over the weekend and I am totally in the right. I will find out tomorrow if there will be a court battle or not, either way I WILL get another car. It is up to mercedes if we do it the easy way or the hard way.

FYI - CA Law says you must pay 1/120000 of the cost of the original car per mile of usage.
I was doing the math, and a 40K car with 6k miles would cost $2000.
