Ok just have to make all you guys feel better about your mb... Just recently bought my c240 only about 3 months old and last night rear ended an m class at a pretty high speed (about 35) and he was at a dead stop (guy ran in front of him on a busy street and he had to slam on the brakes, all agree no one was at fault).
If you are following so closely behind someone that you can't stop when they hit the brakes, either you weren't paying (enough) attention or you were following to close. In California, if you hit someone from behind, YOU ARE AT FAULT. Period. Be prepared for a significant change in your insurance rates.

Is there such a thing as an insurance claim where no one's at fault? It does seem clear that it's the poster's fault if they hit the back of the other's car, and I can't imagine the other driver not saying that you were at fault. I know that I wouldn't be that much of a sucker. I'd just be happy that they weren't injured, and hopefully won't try to get reimbursed for "medical claims".

Insurance companies assign fault by their own rules - except where fault is specifically defined by applicable law. In California, state law is written to clearly assign fault to the guy in back when someone is rear ended.

Physics i know quite well, same with cali traffic code.... but if any of you travel on santa monica blvd rush hour at night you know how dangerous it is and how it's pretty impossible to follow "california basic speed law" which states no matter how far you are behind someone, you are not far enough
i do consider myself to be a pretty safe driver (otherwise i wouldn't be in this car at 19) but still a good lesson on how you can get screwed by outside happenings. and as far as insurance our policy is only going up $1000 over the next 3 years.... not that bad IMO this is mainly to do with the cops statement and the other drivers.

You rear end somebody the evening of the 28th and by the morning of the 30th you know how much your insurance rates are going to change over the next three years? How?
We asked aaa to figure with what the claims person had reported... just was a matter of going down the street and getting some number, not exact but close.
Never woulda even connected the two.
