Didn't take long...

I picked up my coupe from the dealer 10/22 (took three months to get it here from Europe). This morning, while I was sitting at an on-ramp light, a 5-series plowed into me. Early estimate is $10K. Didn't even get to wash it once. Pretty sad to see it being hauled away...

Never heard of suing for market value. Is that ever really done for mass-market cars, or just collectables, or what?

I've heard about this, can't remember the source. Even if your car is repaired, the fact that it has been in an accident will diminish its market value if you decide to sell it. That's what you can sue that person for.

I had the same thing happen earlier this year. the dealer estimated that my car is now worth 3 or 4 thousand less than what it was be before the wreck. Go to the doctor and then go to chiropractor for a while too. You can ALWAYS get 3x your medical bills in pain and suffering.

Leave the guy alone - he'll pay courtesy of his insurer.. But DO investigate your insurance or his paying the differential for market value loss. For goodnes sakes it is only a week old! It should be totalled - to you - and you should be given a new one.
