Guys,
A family friend looking for a a daily driver which would you recommend? She test drove both , likes both but I wanted to see if anyone had experience with 5 series on this board

My buddy just got a BMW 535I loaded, I think the car is nice, bigger space, nice handle and good performance.
I do like his BMW 535I better than my C300 sports, but he paid $59,000 out the door and I only paid around $40000, almost $20000 difference.

If she's leasing or doesn't mind having the 'older body style' when the new one comes out, she might want to look at the E350 too. Seems like there are some incredible deals going on with those.

True, can lease a E350 4matic for $100 less than a C300 4matic right now at my dealership. Can probably buy an E350 for close to what you would pay for a loaded C350 right now as well.

How old is the 535, and what does the fine print in the CPO warranty exclude?
I think the usual answer is that a smaller new car is a better bet than a larger used one, at the same price.
If leasing and the CPO is well warrented, I'd suggest which ever appeals most. The 535 does have a lovely interior!
If your friend is buying and going to keep for a while, I would expect the 5 to be a real cash loser, whereas a 3-4 yr old C would be still sellable. The larger BMW's seem to depreciate very heavily, possibly because a Merc (fairly or not - but thats life) remains a Merc, but the larger BMW's seem to lose any cachet very quickly. Anyone remember what an early 7 series looks like? But w124's are still scooting around Toronto on a daily basis.
As a daily drive, neither makes as much sense as a Corolla, but beyond that emotion is the main "driver". So it's really how your friend feel in the drivers seat.

Well, I did ask how old the 535 was, and added "at about the same price". I assumed that the 535 is over 2 yrs old, so that 3-4 yrs later, when you go to sell or trade it its 6yrs+old. Bit tired and looking for its third owner.

Key part of the equation is the 35 in the 535. That means it's the 3.0TT, which also means it's very new.
If price were the same, I'd take the 535. More power, about the same fuel consumption, more room and better (free service and wear items) warranty. Not much of a looker though.

It may just be me, but I am leary of any used car when i know that i can get a new one for comparable expense.

Nissan GTR, Dinan 335i, C350
I've got 20k on my 335i, oil changed once by dealer and 3 times by me. However, I'm on my second set of rotors and third set of brakes, so the "no maintenance plan" works in ways you don't expect. On that note, STAY AWAY FROM USED 335i(s) and 535i(s). Too many have been modded using piggy-back units which trick the ECU and turbos into running higher boost than stock, sometimes twice as much = more wear and tear. I would never buy a used "35" TT 3.0 motor, in fact I don't plan on keeping mine past 40k.
My car has been issue-free, but a used CPO 535i may have been a buy0back or trade assist. Make sure you get the service records, even though it has been CPO'ed.
