start familiarizing yourself with the lemon law if that replacement part doesn't fix it.

...this doesn't even come close to the lemon law threshold. Why do some people insist on yelling "lemon law" right away?

The OP needs to have a little talk with MB via the 800 number. I suspect that this is an issue that is easily rectified one the right folks look at it - perhaps the dealer just needs a little nudge from MB....

They will fix it. Most likely they need replace the whole command and to do that it probably requires authorization first by MBUSA in case the dealer is replacing an unnecessary part. If the dealer doesn't get the auth first it will get charged back for the part and labor. So let them fix it if it doesn't work it's pretty straight forward you just have to be patient.

His MM stereo and screen doesn't work and one of the dealers can't fix it. If the second attempt with replacement parts can't fix it....well, I've seen more than one vehicle get declared lemon due to nav not working and couldn't be repaired, and MM screen not coming up falls into that category.

Of course, that's why I stipulated if the replacement doesn't fix it. If swapping out the whole unit still doesn't fix anything, then you can make a case.

Why would a dealer ever need to wait for approval to repair a car under warranty? Doesn't make a lot of sense.

because they want to make sure a tech doesn't replace a 5k command system when it just needs a software flash or something simple.

Meanwhile this poor dude is sitting there waiting and hoping for someone to fix his problem on his car that is still under warranty.

Feel your pain! Hope one of those dealer will get their thumb out of their A$$ and fix your issue like a good dealer should. Focus on customer happiness first b4 worrying about who get stuck with the $$ for fixing a legit warranty issue.

...the US lemon laws are Federally mandated state laws that require a manufacturer to buy back a vehicle if there is an issue that cannot be resolved.

While each state law is slightly different, the basics are usually similar.

-The issue must happen within the first year of ownership or 12k miles
-The issue must substantially affect the operation, safety or value of the vehicle.
-The manufacturer must have attempted 3 unsuccessful repairs on that issue or the car was in the shop for over 30 days (must not be consecutive) for that issue.
- thereafter, the owner must write a registered letter to the manufacturer requesting them to resolve the issue or buy back the car.
- the manufacturer may prorate the price based on condition and mileage.

In the OPs case, it isn't clear what the first dealer did - nor is it clear what part the second dealer ordered. I'm also unsure about what caused the issue - was it a modification that caused the initial failure?

Does this failure "substantially affect the operation, safety or value" of the car?

Here is an excerpt from the California law:

"...the "Lemon Law" presumes that a manufacturer has had a reasonable number of attempts to repair the vehicle if either (1) The same problem results in a condition that is likely to cause death or serious bodily injury if the vehicle is driven and the problem has been subject to repair two or more times by the manufacturer or its agents, and the buyer or lessee has at least once directly notified the manufacturer of the need for the repair of the problem as provided in the warranty or owner's manual or (2) The same problem has been subject to repair four or more times by the manufacturer or its agents and the buyer has at least once directly notified the manufacturer of the need for the repair of the problem as provided in the warranty or owner's manual or (3) The vehicle is out of service because of the repair of any number of problems by the manufacturer or its agents for a cumulative total of more than 30 days since delivery of the vehicle..."
