Car accident - person who hit me lies to cops. What should i do?

Car accident - person who hit me lies to cops. What should i do?
This was 1 am. I decided to go out to grab some food at mcdonalds after a long night at work. On the way, i slowed down to see what street i was on. Some 20 year old in a civic comes, swerves to dodge me but loses control and hits my rear passenger door then hits a tree and totaled his car. He tells the cops that we were racing and that i hit the brake and he swerved to avoid me but he did tells the cops hit me. It was a huge street with two lanes. What should i do?

Just tell what happened and insist on it, the cops are not that stupid. Even if you were racing and you hit the brakes, you shouldn't be guilty for him losing control and hitting you. He cannot prove that you have been racing with him whereas the accident proves his reckless driving

The street i was on a pretty big, two lanes on each side. He hit my car then swerved and hit a tree totalling his car, while mine was just all scratched up n dented in.

See if you can get surveilliance footage from the local business, anywhere on the block. If you find a surveillance camera, have the police ask for it from the merchant, they are more likey to cooperate than if you ask them for it.
Also, ask the police to find out if his car is equipped with a recording device trigger when there's a crash. It will show his speed and such for a while before you ran into him and you'll have the McDonalds receipt.
People lie in court all the time to win, you just have to lie a little to even up the score. For example, your honor, the other person wanted to race, acted very aggresive, revved his engine and I was terrified that this person was drunk or on drugs so I pulled over to get out of his way and he lost control of his car and nearly killed me as well as 8 pedestrians standing nearby. Like I said, feed off his lies so he sounds like the idiot.

I assume that you were in the C300 4matic, just say

not exactly sure how it works on other states, but usually the cops take statements from both parties involved, sometimes witnesses if there are injuries, it's pretty much your word against his, at the end its the insurance companies who battle it out and find who's at fault. Did you get a copy of the accident report? Do you agree with what your statement says? if not, go back to the police dept. and change it.

That's what OJ did ..... NOT. Or what Casey Anthony did about her missing baby Caylee .... right. The truth has nothing to do with our judicial system, it's which side wins, who's got the best lawyer(s).
So based on this a hole, get a good lawyer.
I've seen this happen a few times. I was a court witness, after I saw a gal run a light and T-bone a mexican in his small truck ... knocked him out. She lied like a rug, but I was the 3rd person/witness that tipped the scale. Also, a friend was hit from the rear, while exiting a gas station. The jerk told the cops my friend backed into him! Conclusion, nobody's fault.
To OP, remember what you told the cop. You can't deviate from that very much. But look carefully at the damage on your rear right door. Look for signs of rubbing contact, assuming/showing he was going much faster than you.
