And I think you are right. Tethering is not active until I do not start using an app or browser. That icon is now on from when I do start my car.
Also now that you mentioned it, it first shown after I opened my car via mercedes.me app for the first time.

No way to remove other than turn off Mercedes me functions at your dealer.
It means I'll need to learn living with that icon as I use it often. To be fair I only use the aux heater option as the remote is not always with me and at home the car is out of reach for the remote.
