Well, it's just as likely to happen in L.A. as Lancaster, you know how it is here. And, the perpetrator is just as likely not to have insurance.

I've become hypervigilant ever since my little episode, I'm always looking in the rear view mirror.

Went to the tow yard today to take a look and grab a couple things out of the ride....I sure hope they don't try to fix it as it looks pretty bad.

Here are a couple more pics...also car is sitting on the ground so don't know if something happened to ABC but it's gonna be hard to get a jack under it to get the wheels off....

Better meth in Lancaster though.

Looks like she was going every bit of 50mph. The way these cars absorb the crash force while retaining passenger cell integrity is remarkably important in avoiding injury. Glad you weren't hurt and agree that the a CL65 could turn this incident into not such a bad thing after all.

Just to clarify, UMPD (Uninsured Motorist Property Damage coverage) itself will probably not be of much help in your vehicle loss (although UMBI will be critical for your personal injuries). California UMPD coverage is generally limited to $3,500.00, which is not good in this scenario. What you hopefully had at the time of the accident was COLLISION coverage (which covers the value of your car). If you had both UMPD and Collision coverage, you won't have to pay a deductible. If you had Collision but no UMPD, then you will have to pay your deductible. If you had UMPD but no Collision, potential "ouch!"

Also, given the facts as stated by the OP, his Liability coverages will be irrelevant in this case, other than the fact that UMBI limits are capped at the BI Liability limits (i.e., if you want 100/300K UMBI, you have to have at least 100/300K Liability limits). Liability coverage only comes into play when you do something wrong, and getting rear-ended/pushed into the cars in front of you is not a negligent act. Again, this assumes that the OP stopped his car before being hit from behind, and did not otherwise do anything to cause the collision with the cars in front of him.

Isn't it true, though, if the insurance company declares the car totaled and pays him for that, the car is theirs? They will tow it away. They won't want anyone taking anything off the car. So, you have to do that now.

I went through the same thing in the 90's. The car was totaled and I fought to get salvage value on top of the bluebook, so I got extra money. I went to the tow yard and took as much as I could off the car, as fast as I could, because they were going to take it away. I didn't take much, just the radio and some other odds and ends.

I found out from the officer on scene that she in fact didn't present him with proof of insurance card but did give him a policy number and insurance company name, so hopefully I am good to go. My insurance company is already moving forward on the car and will bill out the money spent to the other insurance company if in fact she is insured.

Also, I have $500k in uninsured motorist coverage so per the adjuster that would have covered my car damage only and would not have done anything in regards to medical bills and pain/suffering settlement etc. Either way, I am hopefully all good with regards to the car....now I just have to cross my fingers that it is totaled

Not as informed in depth as some of you seem to speak of in regards to different types of insurances/coverages.. but Bruin, if the car is declared as a totaled vehicle, you're saying that you'll get $500,000? That's enough to buy you a brand new CL65 and that 360 with some change left over, aha.

Sucks about the car though, regardless of it's fate!

NO...just saying that I have a high dollar amount coverage...one of the guys before said something about only a $3,500 limit for uninsured

If it is totaled I will see market value for it which is probably low 40's

Either your adjuster is misinforming you, or you misunderstood him or her.

You need to get your "Declarations Page" from your own carrier to see what coverages you have. Call your carrier and ask them to fax or email your policy dec page to you. Also, ask your carrier to send you the police report and ask your carrier whether they have confirmed if the person who struck you has coverage. If not, you need to understand that, if the other driver was uninsured and you will be making a UMBI claim, your own carrier is your adversary and that they will pay you as little as possible for your injuries. In fact, even if the other person has coverage, there is a good chance that they do not have ENOUGH coverage, in which case you will be making a claim under a different portion of your insurance called Underinsured Motorist Coverage (UIM). Same goes, if you are making a UIM claim, your own carrier is your adversary, and you need to be careful what you say. You may want to get an attorney. So it's confirmed totaled. Insurance adjuster went to the tow yard and called me just now that it has well over $50k worth of damage so it is official. Now I have to see what I get for it.

Anyone know the answer to this, I had added on an extra year to the CPO through Mercedes for $2k and it hasn't gone into effect yet.....can I get the money back for it?

Thanks guys..will keep posted on what I get for it

If you give them the car, can you get salvage value on top of blue book? I did that in the 90's, but I don't know today if one can still do that.

I bought a CPO 2003 SL a few years ago and paid for another 2 years of extended CPO warranty. Traded it for a new 2008 SL within the first year of ownership and the MB dealership said no refund and I was just out of luck.

Sorry for your bad luck.
I have the CPO and the dealer (MB of Omaha) said it would be...guess it's really up to each dealer ship.. as I've owned a couple Franchises and are no rules on how to do business.
Or maybe they said that because I asked..lol guess I'll find out when I sell...

Thanks fellas. I called my MB dealership and they said they put in the cancellation for the warranty and I should get the money back in 4 week or so. They were very friendly and helpful
