I finally lost it today with my Harris situation. It's coming up on 1 year as of Dec. that I paid him for my AMG LSD. So I decided may patience which has been stretched above an beyond most people I know has reached it's full limit. I sent a very straight email to Harris stating that I not prepared to wait to see if he attends the Essen Motor Show and finds out what's happening directly while there(which he stated in his last email to me from Sept).

This is what I just got as an auto reply from him:

---------------------------------------------------------------------------

From: Harton Motorwerks - Harris Tsu [mailto:harris@hartonmotorwerks.com]
Sent: Tuesday, 22 November 2005 11:39 AM
To: Andrew Gordon
Subject: Auto Reply

Dear all,

A family member has passed away. I am devastated and will not reply e-mails during this time.

Please be advised that Harton Motorwerks will not be taking any new orders for the time being.

Regards,
Harris
Now normally with anyone else, I'd have plenty of sympathy for them if I received this message. However, in this particular case I have to say, what's #$%ing next, my goodwill has run dry I'm afraid. And after the many and varied excuses/stories people have been given by him, I have no choice but to wonder...

It's like frigging 'Days of our Lives' with this guy...

I've been watching this thread, and I haven't really seen anyone say "it's time to get the lawyers involved". I think it's unfortunate when you have to do this, but sometimes they are really the only thing left. Get it done. $9000??!?!?!?!?!? I saw someone say?... I would've given him until the day he was 10 business days late to give me money back (and I don't care what excuses about being hosed over by business partners, because I wouldn't have let it get that far, if he didn't I would call my CC company and let them deal with it. If I didn't use a CC I would call a lawyer and get my money back (less attorney's fees).

Weed out the weak, capitalism only works if we vote with our dollar and if they can't hack it, or have the product in-hand without my money, move on to the next guy who can - if you pay more, there might be a reason. How much money did you save by giving $9k to this guy.

I'm not saying it's your fault AT ALL OzSL55, but you gotta admit 1 year is being a little too lenient, why didn't you deal with this a LONG time ago?

It's easy enough to say just get the lawyers involved. It's become so common in the Northern Hemisphere vernacular. Mind you, it's gotten that way here too in the last 10 years. However, in reality try getting an Australian lawyer assist you to successfully take action regarding something you bought in Canada. Also, at the charge out rate of even my least expensive lawyers it's going to cost me a fair amount just to get the ball rolling. I know from day to day business dealing with lawyers, that there very quickly comes a cut off point when the cost of lawyers quickly outweighs the amount you're persuing, especially in these kinds of personal cases(where it's often well under $10k). Hence why people often have to group together legally and often take out class actions to get anywhere.

For $9k (even Canadian ), I'd be on a plane and showing up at this guy's door.

The same thing happened to a friend of mine. He ordered a ~$3000 rear end for his car and the company was ****ing him and a lot of other people around on delivery. Months of promises, lies and delays. He finally said "**** it" and showed up at this douchebag's door. He called the police when he arrived and advised them of the situation, just in case there were problems.

You know what happened? He left with his product

The only reason Harris is taking people's money is that people are letting him.

Probably worth the plane ticket in Johnw(to)'s case for his $9000. However, you won't find me trapesing 8000 miles for my money or the parts. Even in economy the airfares are around $A4000 Sydney-Vancouver. Spending that to recover $US$4,395.00 would be ridiculous!

It's all too easy to make broad statements about people letting him take the money when you don't know each customer's specific situation.
